What Is a TN Visa?
The TN Visa is a nonimmigrant status created under the United States-Mexico-Canada Agreement (USMCA), which replaced NAFTA on July 1, 2020, with eligibility requirements carried over unchanged. It authorizes Canadian and Mexican citizens to work temporarily in the United States in designated professional roles and doesn’t by itself create a path to permanent residence.
Compared to other employment-based categories, the TN stands out for its practicality. There’s no annual numerical cap, no lottery, and no Labor Condition Application (LCA) required from the U.S. Department of Labor. For qualifying professionals, it’s one of the most streamlined routes to U.S. employment available. Applicants must demonstrate nonimmigrant intent, though it’s possible to pursue PERM labor certification for an employment-based green card while maintaining TN status.
TN Visa Eligibility Requirements
Four core requirements determine whether an applicant qualifies. First, the applicant must be a citizen (not merely a permanent resident) of Canada or Mexico. Second, the prospective position must fall within one of the professional categories listed in Appendix 2 of Annex 16-A of the USMCA. Third, the position must be prearranged with a U.S. employer on a full-time or part-time basis; self-employment doesn’t qualify. Fourth, the applicant must hold the credentials the profession requires, typically a U.S.-equivalent bachelor’s degree, though some categories allow relevant experience or a professional license in place of a degree.
Immigration officers at U.S. Customs and Border Protection (CBP) evaluate the actual duties of the position, not just the job title. A role that doesn’t exactly match a listed profession by name may still qualify if the duties correspond. Degrees earned outside Canada, Mexico, or the United States require a credentials evaluation from a recognized evaluation service.

Canadian vs. Mexican Application Process
The path to TN status differs significantly depending on citizenship. Canadian citizens don’t need a visa issued by a consulate. They can apply for TN nonimmigrant status directly at a CBP-designated U.S. port of entry by presenting required documentation to a CBP officer. A prospective employer may also file Form I-129 (Petition for Nonimmigrant Worker) with USCIS on their behalf, and the applicant can enter in TN status upon approval.
Mexican citizens must obtain a TN visa at a U.S. embassy or consulate in Mexico before seeking admission, which requires completing Form DS-160 and attending a consular interview.
Both nationalities must provide:
- A detailed employer support letter describing the professional capacity, purpose of employment, anticipated length of stay, and the applicant’s qualifications
- Evidence of citizenship
- Proof of credentials (degrees, licenses, or foreign credential evaluations)
TN status is initially granted for up to three years and can be extended in three-year increments with no statutory limit on total duration, provided qualifying employment continues.
